For qualifying projects, Greece offers something rare in Southern European licensing: a statutory fast track with binding deadlines, central coordination and tailor-made spatial planning. Law 4864/2021 is the vehicle. Used well, it compresses years of administrative risk; used casually, it becomes an expensive detour. The difference is application quality.
Key Facts
- Law 4864/2021 (Government Gazette A' 237/2021) governs strategic investments, replacing and consolidating earlier fast-track regimes.
- Projects qualify by category, based on investment size and/or job creation, with special provision for emblematic investments and priority sectors — including industry, tourism, energy, technology and the digital economy (data centres among them).
- Approval is granted by the Interministerial Committee for Strategic Investments, with Enterprise Greece as the gateway for applications.
- Incentives can include fast-track licensing with binding deadlines, Special Spatial Development Plans (ESHASE), tax stabilisation or exemptions, expenditure aid and expropriation support — varying by category.
- The framework is a pillar of Greece's effort to attract FDI, which reached a provisional record of €11.4 billion in 2025 (Bank of Greece).
How the Framework Works
Qualification by category
The law defines several categories — Strategic Investments 1 and 2, Emblematic Investments, Fast-Track Strategic Investments and automatically included investments — each with its own thresholds of capital expenditure and/or employment, and each unlocking a different bundle of incentives. Category strategy is itself an advisory question: the "right" category is the one whose incentives match the project's actual bottlenecks.
The process
Applications are filed with Enterprise Greece with a defined dossier — business plan, financing evidence, licensing analysis, environmental documentation. After evaluation, the Interministerial Committee decides on designation. From that point, licensing is centrally coordinated with statutory deadlines for the competent authorities, and, where invoked, the ESHASE process can establish site-specific planning terms through a presidential decree.
The obligations
Designation is not a gift: implementation timetables, reporting obligations and the consequences of non-implementation are part of the bargain. Investors should treat the strategic-investment decision itself as a contract with milestones — and structure their project contracts and financing around those milestones.
When the Fast Track Is Worth It — and When It Is Not
- Worth it: large, complex projects with genuine multi-permit exposure — resorts, data centre campuses, industrial platforms, mixed-use developments — where central coordination and spatial certainty are the binding constraints.
- Reconsider: projects that already fit comfortably within existing planning, where standard licensing may be faster than assembling a strategic-investment dossier; or projects whose commercial timetable cannot absorb the application stage.
- Always: the dossier must be mature. The fast track accelerates decisions on well-prepared projects; it does not repair unprepared ones.
Our Experience of What Makes Applications Succeed
Three ingredients recur: a licensing analysis that demonstrates the applicant already understands its regulatory pathway; financing evidence that stands scrutiny; and internal alignment — the business plan, environmental documentation and legal structure telling one consistent story. Applications assembled as marketing documents fail; applications assembled as execution plans succeed.
